Delhi High Court directs technology companies and cyber cells to take measures against links

10th September 2021: The Delhi High Court has directed that the technological companies, cyber cells as well as the Government take necessary measures to eliminate unpleasant content about women circulating through various links. These links include any kind of obscene photos and videos. So, it is really necessary to take action against these.

The petitioner, a woman has filed the petition to seek court directions to remove websites that circulate morphed photos or nudes as pornography. And also, it was stated that all these things are done through pseudo names.

Justice Subramonium Prasad has been examining the petition. During the process, it was stated that the Union of India and the Cyber Cell of Delhi Police will handle this matter and will look into this issue, and will remove such links and websites carrying such objectionable photos and videos of women.



Transmitting obscene material in electronic form and publishing material containing sexually explicit acts etc., in an electronic form both are punishable under Section 67 and 67A of the Information Technology (IT) Act, 2000. If such photos are circulated without the consent of the person, then it would also amount to a violation of privacy under section 66E of this Act.

These kinds of acts come under “cyber obscenity”; thus, it is also violative and offensive under Section 292 and 292(1) of the Indian Penal Code, 1860.

Earlier in 2021, the Delhi High Court had also stated that if anyone downloads any picture or video from social media accounts of another, like from Facebook or Instagram, and then posts or uses such pictures in a wrong way or posts on any website circulating pornography, then he or she will be punished under section 67 of the IT Act.
