September 22, 2021: The popularly known Samsung is headquartered in Samsung town Seoul South Korea. The company is affiliated to several businesses under the name Samsung electronics Co.Ltd. It is the largest South Korean multinational conglomerate Samsung group dealing mainly with electronics headquartered in Yeongtong District of Suwon.
Samsung Electronics wholly owns the subsidiary name Samsung India under the brand name SAMSUNG by its trademark Samsung which is engraved in a blue oval device.
On July 2013, a trademark with the name of SENTRON with a similar appearance to that of Samsung's trademark appeared. This Sentron’s mark was applied under class 7 for Machines and machine tools. The mark was accepted by the trademark registry and registered in the journal number 2009 on July 19th 2021, without any objection. Even Samsung is having some validly various trademarks with sub- registration under class 7.
Sentron’s Trademark was very much similar to that of Samsung; even the Sentron’s mark also consists that blue colored oval device, where the SENTRON appear same as of Samsung. Even the writing style of SENTRON and SAMSUNG are very much similar. So, there is no wonder that, if someone think that Sentron associated with Samsung in any manner.
Now the question which arises is “Whether the use of such similar device will harness the distinguished character of the SAMSUNG mark, and will that result in harnessing the distinguished link that is present between the Samsung and their goods.?”. With no doubt we can say that, Samsung’s has acquired quite a huge reputation and good brand value. Though it was not granted a well-known status and trademark in India. So, with this the acceptance and advertisement of Sentron’s device will be stack odds in the favor of Samsung. So hopefully they reject the application and refuse to register.
